Terms of Use

These Terms of Use ("Terms") apply to the Phantom Trace apps for Android, iPhone and iPad and to phantomracedev.com (together, "Phantom Trace"), provided by Phantom Racing Development ("we", "us"). By creating an account or using Phantom Trace, you agree to these Terms and to our Privacy Policy.

1. Safety first

Off-road driving and racing are dangerous. Phantom Trace is a tool to help you and your team; it does not replace your own judgment, a co-driver, official course information, or safety equipment.

• Never read or operate your phone in a way that distracts you from driving. Mount the device and let a passenger operate it whenever possible.
• GPS positions, maps, satellite imagery, pace notes, voice callouts and teammate locations can be late, inaccurate or unavailable (for example with poor signal). Do not rely on them as your only source of navigation or safety information.
• Always follow the law, race rules, land-use rules and instructions from event officials.

2. Your account

You must be at least 13 years old to use Phantom Trace. You sign in with Google or Apple and are responsible for activity on your account. You can delete your account at any time in Settings > Account > Delete Account.

3. Acceptable use (zero tolerance)

Teams can share voice messages, waypoints, notes, photos, tracks and team names. You are responsible for what you share. There is no tolerance for objectionable content or abusive users. You must not:

• harass, threaten, bully or impersonate anyone;
• share hateful, sexually explicit, violent, illegal or otherwise objectionable content;
• share someone else's personal information or location without permission;
• spam, or try to access teams, accounts or data that aren't yours;
• interfere with, reverse engineer or overload the service.

You can report users and voice messages and block users in the Team tab. We review reports within 24 hours and may remove content, remove users from teams, or suspend or delete accounts that break these Terms. Team moderators can also remove members from their team.

4. Your content

You keep ownership of the content you create. You give us permission to store, process and share it with the teammates you choose, only as needed to run Phantom Trace. When you delete content or your account, we delete it as described in our Privacy Policy.

5. Subscriptions and free trials

• Some features may require a paid, auto-renewing subscription. Prices are shown in the app before you buy.
• Payment is handled by Google Play or the Apple App Store and charged to that account. We never see your card details.
• Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. Manage or cancel in your Google Play or Apple Account subscription settings.
• Free trials are available once per customer as determined by Google Play or the App Store. If you cancel during a trial, you are not charged.
• Refunds are handled by Google Play or Apple under their policies. Deleting your account does not cancel a subscription.
• Promotional access (for example promo or offer codes) is time-limited and can't be exchanged for money.

6. Apple-specific terms

If you use Phantom Trace on an Apple device, Apple's Licensed Application End User License Agreement also applies. Apple is not responsible for Phantom Trace or its support, and Apple and its subsidiaries are third-party beneficiaries of these Terms.

7. Changes and availability

We may update Phantom Trace or these Terms. If we make important changes to the Terms, we'll update the date above and let you know in the app. Phantom Trace may sometimes be unavailable, for example during maintenance or outages.

8. Disclaimers and liability

Phantom Trace is provided "as is" and "as available", without warranties of any kind, to the fullest extent allowed by law. To the fullest extent allowed by law, we are not liable for any indirect, incidental or consequential damages, or for any injury, damage or loss arising from driving, racing, navigation, or reliance on information in Phantom Trace. Some places don't allow these limits, so they may not apply to you.

9. Ending these Terms

You can stop using Phantom Trace and delete your account at any time. We may suspend or end access for anyone who breaks these Terms.
